This is a working draft written for From the Vine Juices LLC to hand to its own lawyer before launch. It has not been reviewed by one. Anything shown as a bracketed TODO is a fact we do not have yet, and the document is not binding on anybody until it is finished and published as final.
These terms cover what you are buying from From the Vine Juices, what we promise, and what we cannot promise. The short version: our juice is raw and perishable, it is food and not medicine, we press to a weekly calendar, and we need you to be honest with us about your body.

About these terms
From the Vine Juices is operated by From the Vine Juices LLC of [TODO: business address] (in these terms, we, us and our). They apply every time you place an order, start a subscription or use fromthevinejuices.com.
By placing an order you confirm that you have read these terms, that you are at least 18 years old, and that the information you gave us about your body is accurate to the best of your knowledge. If you do not agree with any part of this page, please do not order.

What we sell
Cold-pressed juice, built to the profile you fill in, plus wellness shots as an add-on. We press one batch a week and we only press what has been ordered, so nothing is made in advance and nothing sits in storage.
You can buy a one-off pack or subscribe weekly. A multi-week pack is pressed a week at a time, one batch per week - cold-pressed juice does not keep long enough for us to hand over a month of it at once.
We offer local pickup and local delivery only. We do not ship, and we cannot arrange a courier on your behalf. Anyone outside metro Atlanta can collect in person or not order.

Our juice is unpasteurized
Cold-pressed juice is raw. It is never heat-treated and never pressure-treated, which is what keeps the nutrients intact and is also the reason it carries a risk that shelf-stable juice does not.
This product has not been pasteurized and therefore may contain harmful bacteria that can cause serious illness in children, the elderly and persons with weakened immune systems.
If you are pregnant, immunocompromised, elderly, or buying for a young child, please talk to a doctor before drinking raw juice. Ordering is your acceptance of that risk.

This is food, not medicine
Our juice is a food product. It is not a drug, a supplement, a treatment or a diagnostic tool, and nothing we sell has been evaluated by the Food and Drug Administration.
The health goals you rank in the form tell us which ingredients to lean on. They are a preference, the same as telling us you like tangy over earthy. We make no claim that any bottle will diagnose, treat, cure or prevent any condition, or produce any particular result for your body.
Nothing on this site is medical advice and nobody here is your clinician. Do not stop, start or change any treatment because of something we press or something you read on fromthevinejuices.com.

Medications and supplements
We ask whether you take medications or supplements, and which ones, because some produce genuinely interacts with them. Grapefruit and citrus affect how a number of drugs are metabolised, leafy greens carry vitamin K that matters to anyone on an anticoagulant, and a sweet juice is a real amount of sugar to anyone managing blood glucose.
A person at From the Vine Juices reads your answers before your batch is pressed and may leave an ingredient out, ask you a question, or decline the order. That review is a sensible kitchen precaution. It is not a pharmacist check, it is not a clinical review, and you must not treat our willingness to press an order as an opinion that the juice is safe alongside your medication.
Deciding whether a juice is safe with your medication is your doctor's job, not ours. Ask them first, and tell us if their answer changes what you can drink.

Allergies and cross-contact
Tell us everything you react to, using both the checklist and the note underneath it. We will not knowingly put a listed allergen into your bottles, and a note is read by a person rather than filtered by software.
We press in one kitchen on shared equipment. Every batch for every customer goes through the same press, the same lines and the same surfaces, so we cannot guarantee that any bottle is free of traces of anything we handle - including citrus, nuts, seeds and every item on the allergen list.
If your allergy is severe or anaphylactic, do not rely on us. We cannot operate an allergen-free facility and we will not pretend otherwise.
Keeping your profile current is your responsibility. If an allergy, medication or restriction changes, update it before the next cutoff - we press against the profile as it stood when the batch closed.

Ordering and the weekly cutoff
The week runs to a fixed rhythm. Orders close Wednesday at 11:59pm, produce is bought against the closed list, the press finishes Friday, and you receive your juice on Saturday. Times are local to our kitchen (America/New_York).
An order placed after the cutoff joins the following week. Changes, additions and cancellations reach us in time only if they arrive before the cutoff; once produce has been bought for you, that week is committed.
Each batch has a limited capacity. If a week is full your order may be waitlisted or moved to the next available batch, and we will tell you before taking payment. An order is only accepted once we confirm it by email - a completed checkout is an offer, not yet a contract.

Prices and payment
Prices are shown at checkout in US dollars and include any delivery fee that applies to your order. We may change prices at any time, but never for an order or a subscription period you have already paid for.
Payments are processed by Stripe. Your card details go to Stripe directly and never reach our servers. If a payment fails we will tell you; an unpaid order is not pressed, and a subscription with a failed payment is held until the card is fixed.

Subscriptions and cancellation
A subscription bills weekly, in advance, for the pack you chose, and holds your place in each batch until you cancel. Your subscription is pressed against your most recent profile, so an update before the cutoff carries into the next week automatically.
You can cancel at any time from your account with no fee and no notice period.
Cancellation takes effect from the next batch whose cutoff has not passed. A batch that has already closed has already been bought and pressed for you, so it is still charged and still yours to collect.
We may cancel or decline a subscription ourselves - for example if we cannot press safely against your profile, if you are outside the delivery area, or if orders repeatedly go uncollected. If we do, we refund anything you have paid for a batch we have not yet pressed.

Pickup, delivery and collection
Handover is Saturday, 4pm to 7pm. Pickup is from [TODO: pickup location]. Delivery is available within metro Atlanta and nowhere else.
Your juice leaves a refrigerator to be handed to you, and it needs to go into another one quickly. You, or somebody you have asked to collect for you, must be there during the window. For delivery, somebody must be able to receive it - we will not leave bottles outside in the heat, and we cannot come back later in the day.
An order that is not collected within the window is not held over and is not refunded. It is fresh, unpasteurized juice that has been out of refrigeration, and we will not hand you something that has been sitting.
Risk in the juice passes to you when it is handed over or delivered. Tell us before the cutoff if you will be away and we will skip your week.

Storing your juice
Refrigerate immediately and keep it refrigerated. Unpasteurized juice keeps about five days from pressing, which is why we press the day before you get it. Separation is normal - shake it. If a bottle smells sharp, fizzes, or tastes off, do not drink it.
We cannot be responsible for juice that has been left out of refrigeration, drunk after its date, decanted, or passed on to someone whose allergies and medications we know nothing about.

Refunds
All sales are final and we do not offer refunds. Every order is built to your profile and pressed to order: the produce is bought against your batch and the bottles are pressed for you specifically, so there is nothing to put back on a shelf. Uncollected orders are not refunded either.
That is not the same as not caring. If something is wrong - a bottle is spoiled, an order is short, or a juice contains something you told us to keep out - email us at hello@fromthevinejuices.com and we will put it right. Tell us straight away if the problem is a safety one, and stop drinking it.
Nothing here limits any right you have under consumer law that cannot be limited.

Your account and your information
Accounts are handled by Clerk. Keep your login details to yourself - you are responsible for what happens under your account, and anyone who reaches it can read your health profile.
You agree to give accurate information and to keep it up to date, particularly allergies, dietary restrictions and medications. We decide what to press from what you tell us, so an out-of-date answer is a real risk to you. We may suspend or close an account that is being used dishonestly or abusively.

Our content and brand
The From the Vine Juices name, logo, photography, site copy and recipes belong to us. You are welcome to use the site to order juice and to share a link to it. You may not copy the site, resell our juice, or use our branding without written permission.

Limitation of liability
We take food safety seriously, and there are limits to what we can be answerable for. To the fullest extent the law allows:
- We are not liable for indirect, incidental or consequential loss, or for lost income, arising from an order.
- Our total liability for any claim connected to an order is limited to the amount you paid for that order.
- We are not liable for a reaction caused by information you did not give us, by an interaction with a medication your doctor had not cleared, or by juice that was stored or handled badly after handover.
Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
If you are having a severe reaction, call emergency services first. Tell us afterwards.

Changes to these terms
We may update these terms. The version on this page, with the date at the top, is the current one, and changes take effect when they are posted. A change never applies backwards to a batch you have already paid for. Continuing to order after a change means you accept it.

Governing law
These terms are governed by the laws of Georgia, and any dispute will be heard in the courts of Georgia. If any clause turns out to be unenforceable, the rest stays in force.
